Terms of Service

1. The service

Home8 ("the Service") is a cloud-based platform operated by App8 BV (Honsemsestraat 50, 3370 Boutersem, Belgium, BTW BE 0809.835.380) that allows users to design touchscreen dashboard interfaces for ESP32 devices running ESPHome, connected to Home Assistant via LVGL. The Service includes a visual screen designer, cloud compilation of ESPHome firmware, over-the-air update delivery, and device heartbeat monitoring.

2. Accounts

• You must provide accurate information when creating an account.
• You are responsible for keeping your login credentials, API keys, and WiFi passwords confidential.
• You must be at least 16 years old to create an account.
• One person or entity may not maintain multiple free accounts.
• You are responsible for all activity that occurs under your account.

3. Acceptable use

You agree not to:

• Use the Service for any illegal purpose or in violation of applicable laws.
• Abuse the cloud compilation service (e.g. excessive builds, automated scripting against the API).
• Attempt to gain unauthorised access to other users' accounts, screens, or data.
• Reverse-engineer, decompile, or extract source code from the Service.
• Use the Service to distribute malware or interfere with other users' devices.
• Resell or redistribute access to the Service without written permission.

We reserve the right to suspend or terminate accounts that violate these terms.

4. Billing and payments

• Home8 offers free and paid plans. Paid plans are billed monthly or yearly via Stripe.
• Prices are displayed excluding VAT for verified B2B customers and including VAT for all others. Belgian VAT (21%) applies unless reverse charge is applicable.
• You can cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — no refunds are given for partial periods.
• After cancellation, screens enter a grace period (default 7 days) during which you can resubscribe. After the grace period, screens are deactivated and eventually deleted.
• We may change pricing with 30 days' notice. Existing subscriptions continue at the original price until the end of their current billing period.

5. Intellectual property

• Your content: You retain ownership of your screen designs, layouts, and configurations. By using the Service, you grant Home8 a limited licence to process your content solely for the purpose of providing the Service (compilation, storage, delivery).
• Our platform: The Home8 platform, including its design, code, documentation, branding, and compilation infrastructure, is owned by App8 BV. You may not copy, modify, or create derivative works from the platform.
• The generated ESPHome firmware is a derivative of your design combined with open-source ESPHome components. You may use the compiled firmware freely on your own devices.

6. Service availability

We strive to keep Home8 available and reliable, but we do not guarantee uninterrupted or error-free service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or damage resulting from service interruptions.

7. Termination

• You may delete your account at any time from Settings → Data → Delete Account. This permanently removes all your personal data, screens, and configurations.
• We may suspend or terminate your account if you violate these terms, with or without prior notice depending on the severity of the violation.
• Upon termination, your right to use the Service ceases immediately. Data deletion follows our standard retention policy.

8. Limitation of liability

To the maximum extent permitted by Belgian law:

• Home8 is provided "as is" without warranties of any kind, express or implied.
• App8 BV is not liable for indirect, incidental, special, or consequential damages.
• Our total liability for any claim related to the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
• We are not responsible for the operation of your ESP32 devices, Home Assistant instance, or local network.

9. Changes to these terms

We may update these Terms of Service from time to time. We will notify registered users of material changes via email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated terms.

10. Governing law

These terms are governed by Belgian law. Any disputes shall be submitted exclusively to the courts of Leuven, Belgium.
